This Website (“Website”) is operated by ONYX DESIGNS. Throughout the site, the terms “we”, “us” and “our” refer to ONYX DESIGNS. ONYX DESIGNS offers this Website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our Website and/ or purchasing something from us, you agree to and agree to be bound by the following:

 The Terms apply to all users of the Website, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

ORDER AMENDMENTS AND CHANGES

ONYX DESIGNS is not liable for accuracy of orders and you should double check your order before finalising.

Any changes or amendments to orders can be requested up to 24 hours after placement of order by contacting admin@onyxdesigns.com.au.

*Please note all requested changes and amendments to orders are not guaranteed and are subject to availability.

ONYX DESIGNS is not responsible for providing input for personalisation of products.  You should ensure you have provided details of personalisation you want on any products before finalising an order.

Once an order is placed, cancellations to orders are not permitted.

SHIPPING AND HANDLING 

All orders will be dispatched  within 3 business days. Please note that during peak periods, these times may be subject to change.

Parcels using tracked shipping method means the package will be tracked through to delivery. Please ensure you check with your local national carrier for further updates.

ONYX DESIGNS does not take any responsibility for delays or items sent to invalid or incorrect addresses. ONYX DESIGNS is not responsible for items returned to sender for the following reasons:

- Incorrect/ insufficient address
- Unclaimed from the post office
- Failure to pay taxes/customs fees

If a package is returned or rejected, it is the customer’s responsibility to email admin@onyxdesigns.com.au to arrange redelivery and may be liable to pay for postage costs.

Some postal services will deliver your item to your door, porch and/or mailbox. ONYX DESIGNS will not be held responsible for any theft or damage if your parcel is left at an unattended address.

The Customer Service team will provide as much assistance as possible to trace a missing parcel, however, it is the customer’s responsibility to follow up with their local carrier.

PRODUCT AVAILABILITY 

All products are subject to availability. ONYX DESIGNS will endeavour to ensure all quantities displayed online are true and accurate, however will not be liable for any products that are not available at the time of your checkout. 

We have made every effort to display as accurately as possible the colours and images of our products that appear in the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

ONYX DESIGNS reserves the right to terminate or cancel orders when there has been a website malfunction, technical disturbance or incorrect price displayed. A notification to the customer will be immediately sent and any payment received from the customer will be refunded.

All ONYX DESIGNS products are branded and will have the “ONYX Designs” logo present. This applies to all monogrammed products.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SHIPPING TIME FRAMES

Australia:

Australia Post Standard: 4-6 Business Days
Australia Post Express: 1-2 Business Days

International:

Australia Post Standard: 7-15 Business Days

Please be aware orders can be withheld in customs for processing which is mandatory with certain customs regulatory bodies. These delays are not the responsibility of ONYX DESIGNS and customers will not be reimbursed if orders incur customs charges.

If you have selected ‘Safe Drop’ for your delivery, ONYX DESIGNS is not accountable for any parcels that are lost or stolen as a result of electing ‘Safe Drop’ delivery service.

TAXES DUTIES AND/OR CUSTOMS FEES

There may be taxes or duties applied by customs towards your order when, or after delivery is made. Please know these charges are not inclusive of the original shipping charge and are unable to be paid for or reimbursed by ONYX DESIGNS

If you do not pay your customs fees your order may be destroyed/abandoned and we are unable to provide an reimbursement of your order. It is the customers responsibility to contact the relevant customs office to find if you are affected by these charges.  

RETURN AND EXCHANGE POLICY

Under no circumstances will monogrammed or customised products be accepted for return due to change of mind. We do not refund or exchange monogrammed or customised products unless the item is faulty. 

ONYX DESIGNS is not liable for incorrectly purchased products. If an item is incorrect, ONYX DESIGNS is unable exchange, replace or refund these products.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

If your product is faulty or damaged in transit ONYX DESIGNS will repair or replace your product as necessary, free of charge. Items that are damaged as a result of normal wear and tear are not considered to be faulty.

PROMOTIONS & DISCOUNT CODES 

ONYX DESIGNS will not produce or distribute discount codes unless stated otherwise. Promotions and discounts will be announced on all social media and email outlets.

If a discount code is valid, it is the customers’ responsibility to apply this to their order at the time of purchase only. ONYX DESIGNS is not liable or obligated to apply any discount codes once an order has been processed. 

All orders purchased in any sale period are exempt from exchanges, refunds and/or replacements.

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms & Conditions.
